Here are the terms and conditions (T & C’s) for Lindsey Rodriguez, 380B Taille de Mas des Frênes, 74110 Morzine, hereafter referred to as “Chalet Morzine”, “We”, “Our” or “Us”. These terms and conditions form the basis of your holiday contract with Chalet Morzine. They set out the respective rights and obligations of renting Chalet Morzine on a self-catered basis, please read them carefully.

1 The booking agreement & contract

1.1 The party leader (who must be at least 18 years of age) must complete the Chalet Morzine booking form on behalf of all persons named on the form, and in doing so confirms everyone’s acceptance of these booking conditions.

1.2 He/she is responsible for all matters relating to the booking and will be personally liable for all monies outstanding to Chalet Morzine from the remainder of the group.

1.3 By completing a booking form the group leader agrees on behalf of all party members that:

  • 1.3.1 He/she has read these terms and conditions and agrees that all members of the group are bound by them
  • 1.3.2 He/she is over 18 years old
  • 1.3.3 All information provided to us by you is correct and accurate

1.4 The group refers to all persons booked to stay with Chalet Morzine on the booking form.

1.5 If, at any time prior to the start of the holiday, there is a change of group leader; Chalet Morzine must be notified, either by email or telephone, by the original group leader and a new booking confirmation forwarded.

1.6 Once Chalet Morzine has received your booking form and appropriate payment, Chalet Morzine will confirm your holiday by issuing an invoice. It is at this moment when a binding contract comes into existence between you and Chalet Morzine.

1.7 French law governs this contract, and all matters arising out of it. In the unlikely event of any dispute coming between you and Chalet Morzine, we both agree that this will be dealt with by the courts in France.

1.8 The invoice will state when the final payment is due and, whilst we will endeavour to send you a reminder, it is your responsibility to ensure that payment is received in full and on time (usually 2 calendar months before departure). Failing this, we reserve the right to treat your booking as cancelled by you and cancellation charges set out in Clause 5 will be payable.

1.9 Please check the invoice as soon as you receive it and raise any queries with Chalet Morzine immediately. If Chalet Morzine then deems your holiday as cancelled we reserve the right to rebook the rooms without further notice.

2. Booking & Payment

2.1 Following a booking request from you by email or via the phone, we will send confirmation of availability, a booking form, the total booking price and the deposit amount to be paid. You then have seven days within which to send the deposit payment and the fully completed booking form back to us.

2.2 If a booking request is within 2 months of travel, full payment is required at the time of booking.

2.3 Once funds are fully cleared and the booking form checked, we will email you a booking confirmation.

2.4 If, after 7 days from the initial booking request the booking form and appropriate payment have not been received, Chalet Morzine reserves the right to consider the booking cancelled and to rebook the rooms without notification.

2.5 Payment is accepted by bank transfer in euros only. Any international bank transfer costs, or other payment costs, must be taken on by you, not Chalet Morzine. Chalet Morzine is not responsible for any payment discrepancies caused by variations in exchange rates used by your bank.

3. Pricing

3.1 Prices are based on the exclusive use of Chalet Morzine and will therefore remain the same irrespective of the number of guests, up to the maximum capacity of 15. We reserve the right to increase or decrease our prices and therefore offer no guarantee that postponed reservations will be offered at the same price as the original booking.

3.2 Chalet Morzine guarantees the price of your holiday as quoted at the time of booking and as stated in your booking form. Chalet Morzine reserves the right to increase or decrease the advertised price of unsold holidays at any time.

3.3 The price of your self-catered chalet holiday does not include flights, travel costs, transfers from Geneva, holiday and medical insurance, lift passes, ski or bike hire, ski lessons or childcare.

3.4 Prices in resort may change and whilst any information and quotes on external services (e.g. for airport transfers)  will be given as accurately as possible, Chalet Morzine accepts no responsibility for any variation in price that may take place between the quote and arrival into the resort.

3.5 For all stays at Chalet Morzine,  what is included will be specified at the time of booking. However, you can assume as standard that the booking includes full and exclusive use of the chalet (except for the owner’s apartment), garage, hot tub, and garden.

4. Insurance

4.1 It is a requirement of booking that all persons booked to stay at Chalet Morzine are required to purchase appropriate and adequate holiday insurance, covering at least;

  • 4.1.1 Cancellation or interruption of your trip;
  • 4.1.2 Travel delays and transfer costs (including additional costs incurred in the event of any delay);
  • 4.1.3 Emergency medical expenses, including, but not limited to, mountain rescue, ambulance and repatriation costs;
  • 4.1.4 Winter / Summer sports and any activities you may do in the resort;
  • 4.1.5 Risks and costs incurred by third parties as a result of damage to property or adjacent property caused by you or any member of your party, your employees or visitors during your stay;

4.2 It is the responsibility of the group leader to ensure that each member of the group has adequate cover.

4.3 In the event that you fail to obtain appropriate insurance in accordance with this clause, Chalet Morzine will not be liable for any costs incurred or claims made against us as a result of your failure to comply with this condition.

4.4 We also recommend that you take out adequate insurance to cover your personal belongings.

4.5 In order for us to assist you in an emergency, it is helpful for us to have information about your travel insurance policy. Please provide us with this information at the time of booking.

5. Alterations and /or cancellations by you

5.1 Should you wish to make any changes to your chalet holiday arrangements after they have been confirmed, you must advise Chalet Morzine in writing. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests.

5.2 Any alterations made to the existing booking, except additions or transferral of names, may be deemed a cancellation and the charges, as set out below, may apply. It may also be necessary to levy a small administrative charge to process any alterations.

5.3 Should you or any member of your party need to cancel your stay once it has been confirmed, the group leader must immediately advise us in writing. Chalet Morzine takes no responsibility for non-delivery or non-receipt of such written cancellation.

5.4 The following cancellation charges will be applied. These charges are calculated from the date on which Chalet Morzine receives written notice of the cancellation.

From booking: Deposit*
6-8 weeks prior to arrival: 50% of total holiday cost*
4-6 weeks prior to arrival: 75% of total holiday cost*
4 weeks or less: 100% of holiday cost*

* Excludes insurance

5.5 Non-receipt of the balance of the cost of your winter ski self-catered chalet holiday or family summer activity holiday with Chalet Morzine will not be taken as notification of cancellation. You will still be liable for cancellation charges as shown above if you subsequently cancel the holiday.

5.6 In addition to the cancellation charges, we reserve the right to pass on any charges made by the suppliers of any services booked by us on your behalf (e.g. transfers). Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy.

6. Alterations and /or cancellations by us

6.1 We reserve the right to make minor alterations to the guidebook, website and holiday details before and after bookings have been confirmed. In the case of a minor or significant alteration being made, we will advise you at the earliest possible date.

6.2 In the event of a significant alteration, you may accept it or cancel your stay and receive a full refund. Chalet Morzine will pay no compensation.

6.3 Very occasionally, it may be necessary for Chalet Morzine to cancel a confirmed holiday and as such we reserve the right to do so. If we do so you will receive a full refund of all the monies paid, or if requested we will endeavour to find alternative accommodation of the same value. We accept no legal liability and will pay no compensation.

6.4 Very rarely, we may be forced to curtail your holiday after the date of departure where circumstances amounting to ‘force majeure’ occur as described in Clause 7 below. In this very unusual situation, we regret we cannot make any refunds (except where refunds are obtainable from a supplier), meet any cost or expenses you may incur as a result or pay any compensation.

7. Force Majeure

7.1 We regret we cannot accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by ‘force majeure’. In these booking conditions, ‘force majeure’ means any event, that we or the supplier of the service (s) in question could not, even with all due care, foresee or avoid.

7.2 Such events may include war or threat of war, political unrest, adverse weather conditions, riots, civil strife, terrorist activity, industrial dispute, natural, nuclear or technical disasters, volcanic ash disruption, fire, epidemics, pandemics, Covid 19 outbreaks and consequent governmental decisions, acts of God and all similar events outside our control.

8. Our liability to you

8.1 Chalet Morzine accepts responsibility for ensuring that all parts of our contract with you are properly performed subject to the following exceptions, which Chalet Morzine will not accept liability for:

  • 8.1.1 Any failure to perform or improper performance was due to: (i) the act(s) and/or omission (s) of the person (s) affected or any member (s) of their party or (ii) those of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or (iii) an event which either ourselves or the supplier of the services in question could not have foreseen or forestalled even with all due care.
  • 8.1.2 Any cancellation, loss, delay or costs whatsoever and howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides, snow conditions, airline strikes and the effect that any of these may have on travel arrangements, accommodation and activities.
  • 8.1.2.1 Limitations imposed by resort authorities, ski-lifts, ski hire or ski school operators.
  • 8.1.2.2 Travel arrangements made by the group or on behalf of the group.

8.2 In the event of any liability being accepted, we shall not be liable for more than the cost of the accommodation component booked through Chalet Morzine. No further compensation will be paid out.

9. Client Liability & Expected Behaviour

9.1 When you book a holiday with Chalet Morzine, the group leader accepts total responsibility for any damage or loss caused by yourself or any member of your party, to Chalet Morzine property, grounds, vehicles and all equipment. Full payment for any such damage or loss must be immediately made to us or the third party concerned and the payment responsibility lies with the group leader, irrespective of who caused the damage. If you fail to do so, you must indemnify Chalet Morzine against any claims (including legal costs) made against us as a result of your actions.

9.2 We expect all clients to have consideration for other people. If, in our reasonable opinion, you or any member of your party behave in such a way as to cause or to be likely to cause, distress, danger or annoyance to any third party (such as other clients, staff, or local residents), excessive noise inside or within the chalet grounds, or a negative impact on the reputation of Chalet Morzine, we reserve the right to terminate the holiday of the person concerned without notice.

9.3 In the above situation, our responsibilities towards that person (including any return transport arrangements) will immediately cease and we will not be responsible for meeting any costs or expenses they may incur as a result. We will not make any refunds or pay any compensation to the individual involved or to members of his/her party or associates wishing to curtail their holiday as a result.

9.4 Any persons not booked into Chalet Morzine can only visit the property with prior notification and with the permission of Chalet Morzine. If a client is in breach of these terms and conditions, Chalet Morzine reserves the right to refuse to further accommodate them and contractual obligations will be terminated immediately.

10. Damage Deposits and Care of the Property

10.1 For all self-catered rentals of the chalet, a security deposit of 500 Euros against damage, loss or breakages will be required and shall be payable to our management team on arrival at the property. This security deposit will only be accepted in cash. The deposit will be refunded at the end of your holiday, providing the accommodation is left clean and without defect. The sum reserved by this clause shall not limit your liability to Chalet Morzine.

10.2 The client agrees to be a considerate tenant, to take good care of the property and to leave it in a clean and tidy condition at the end of the rental period. Although a light final clean is included in our prices, we reserve the right to make a retention from the security deposit to cover additional cleaning costs if you leave the property in an unacceptable condition. Prior to departure, we would ask that;

  • 10.2.1 All rubbish & recycling is removed from site
  • 10.2.2 All food is removed from cupboards and fridges
  • 10.2.3 The dishwasher is on or emptied
  • 10.2.4 Notify us of any broken crockery / glasses, or anything no longer working in the chale
  • 10.2.5 Beds stripped and all linen and towels left in two separate piles in the games room
  • 10.2.6 Move any furniture and items back to their original location if they have been moved
  • 10.2.7 All communal areas are hoovered and/or swept
  • 10.2.8 Check all doors and windows closed and locked, and that the outside garage key is in the key safe

10.3 The client shall report to the Chalet Morzine management team without delay any defects in the Chalet or breakdown in the equipment / appliances provided so that arrangements can be made for their repair or replacement.

11. Log Fire

11.1 Care must be taken when using the log fire. Never overload the fire with wood, or leave it unattended. Clothes or other items should never be dried directly in front of or on top of the fire – there is a boiler room for that.

11.2 Chalet Morzine accepts no responsibility for damage to guests, guest clothing or other property belonging to guests as a result of using the fire. 

11.3 Chalet Morzine property damaged as a result of guest use of the fire will be charged accordingly.

12. Hot-tub

12.1 Guests use hot tubs at their own risk and Chalet Morzine accepts no responsibility for death or personal injury caused through their use. Special care should be taken at all times, especially when getting into and out of the hot tub. Extra care should be taken during cold and icy conditions as the areas surrounding the hot tubs cannot be salted to remove ice.

12.2 Children must be supervised by an adult at all times to avoid the risk of drowning and/or overheating. We recommend that children under the age of 12 years of age do not use the hot tub. 

12.3 Any spillage, damage or items being dropped into the hot tub that could get into the filter should be immediately reported to us. 

12.4 We reserve the right to close hot tubs for reasons related to, but not limited to, damage, chemical imbalance, breakdown, vandalism or unsafe conditions. Any closures will not constitute a significant change as detailed in section 8.5. Therefore, compensation will not be payable to guests.

12.5 Hygiene and usage instructions for the hot tub are detailed in the chalet guest book and must be observed by all guests.

13. Smoking

13.1 For health and safety reasons there is a strict no smoking or vaping policy anywhere inside the chalet, including the garage. Clients may only smoke on designated balconies and must use the ashtrays provided.

14. Lost and stolen Property

14.1 Any client not properly securing the exits after leaving the chalet will be liable for any property stolen as a result of that negligence.

14.2 Chalet Morzine will not be held responsible for any theft or loss of personal possessions from our premises.

15. Outdoor shoes & Equipment

15.1 The wearing of outdoor shoes in the chalet is not permitted. This includes ski boots, snowboard boots, mountain biking or road cycling shoes. Floors can become very slippery once they are wet, please leave your shoes to dry in the boiler room. 

15.2 All outdoor equipment, which includes but is not limited to mountain bikes, skis and snowboards, and dirty, soiled or extremely wet clothing, must be stored in the garage. 

15.3 Under no circumstance is the repair or maintenance and cleaning of such outdoor equipment, as stated above, allowed within the internal space of the property including terraces, balconies and garden areas. This also includes waxing of skis or snowboards in winter. Mountain bikes should be washed in the designated area only. 

16. Third Party Suppliers & Activities

16.1 Chalet Morzine can assist in sourcing and booking transfers in relation to your holiday. This does not constitute an approval of these services or suppliers and we take no responsibility or liability for 3rd Party services. Therefore, you are subject to the terms and conditions of the individual 3rd party companies and any grievance with a third-party service should be taken up with that provider directly.

16.2 Our help in organising or recommendations for 3rd Party suppliers for services such as transfers, ski lessons, equipment rental, childcare, or catering does not constitute a package holiday or linked travel arrangement and therefore falls outside of the Package Travel Regulations

17. Children

17.1 Whilst we try and make our chalets as child-friendly as possible, they are by no means completely childproof. Chalet Morzine will not be held responsible for any accident occurring within the chalet. It is the parent’s responsibility to ensure that their children are supervised at all times.

17.2 Due to the wide-ranging nature of equipment required for childcare within the chalet, and the frequency with which items have historically been broken, we no longer provide an equipment list and instead request that you ask us for the items you need and we will let you know whether these are available in the chalet prior to your travel dates.

17.3 Any items we do provide must be checked over by parents to ensure they are satisfactory and secured. We accept no responsibility should an accident or injury occur as a result of the use of such items. Parents assume full responsibility for the safety and well-being of their children at all times.

17.4 Any arrangement of childcare based on our recommendation is subject to Clause 10, above. 

18. Skiing to the door

18.1 The chalet is situated just off piste B and under normal snow conditions you can ski back to the door, off piste, to within 20 metres of the chalet. This is only for people who know how to ski and is not suitable for beginners, who will need to ski back to the Pléney lift and then walk back to the chalet. Skiing to the lifts requires a steep walk on an off-piste track to either get to piste B or a 5-minute walk on a flat piste (so need to use the ski poles) to ski off-piste to the chairlift.

18.2 If there is no snow these options are not possible and Chalet Morzine cannot be held responsible for this convenience not being available.

19. Animals

19.1 Chalet Morzine does not accept pets. 

20. Passport, visa and health requirements

20.1 We cannot accept any liability if you are refused entry onto a flight or into any country, due to failure on your part to carry the correct passport, visa or other documents required by any airline or authority. Most flights are into Geneva, Switzerland, which is not an EC member.

20.2 Before travelling you are advised to check with your own doctor for your own medical requirements. It is highly advisable to have proper medical insurance and not to rely on the European Health Card as it is not widely accepted.

21. Complaints

21.1 In the unlikely event of you having a complaint with any part of your holiday, you should notify us immediately.

21.2 Any complaints made on or after departure will not be considered. Complaints cannot be accepted for airport transfers, snow conditions, childcare, weather, lessons and closures of ski – lifts and other services provided by 3rd party suppliers or for anything outside of our direct control.

22. Website Description

22.1 All descriptions and photography on the Chalet Morzine website are given in good faith on the information available to us and believed to be correct. This is in relation to all aspects, including lifts, activity pricing and information. 

22.2 The chalet is privately owned and has an official 3 star tourist qualification.
